Yeah, he said it during a private phone call to Nick in prison that somebody recorded and gave to some variety of media. Not a great thing to say but 1. it was private and 2. I don't see how anybody can slate him for it unless they've been in the same position. But the TMZ's of the world will always be the TMZ's of the world.
