They did have that clause, not sure if they still do though.

ND plays teams that tend to be tough each year, with a few that are pushovers every year. But how is that different from any other team in the country? Every major program in the country schedules some pussy D-1A or D-1AA teams that they can beat the shit out of every single year. So I don't wanna hear an shit about ND having a cupcake schedule, they're no different than any other team in the country.
