The Supreme Court is expected to make a decision this Fall regarding a legal case involving the First Sale Doctrine with the implications being against the consumer if manufactures win.

While the case itself doesn't specifically involve video games, they would fall under the provision to be removed from the protection the Doctrine provides to consumers.

The current case of Kirtsaeng v. John Wiley & Sons involves the side of John Wiley & Sons requesting portions of the Doctrine to be overturned or amended to remove any product manufactured "overseas" from its protection.

The publisher also wants those products to then fall under the copyright protections which provides more power to manufactures in determining who can or can't sell/resell their products regardless of location.

As of now the Court is split on the legality of the product's origin and location of sale mattering which will end up playing a large role in their actual decision later on.

Should the Court side with the publisher, video game consoles would automatically be exempt from the Doctrine while games in general could if the exemption is expanded again in the future.

It's a free-video game project based on the Community video game. They attempted to create a video game in 16-byte design based on the game the study group played in "Digital Estate Planning." It's not fully done yet, but the site also has awesome midi themes from the game and fan created ones based on some of the songs from Community (including Getting rid of Britta which was awesome.) Somebody even made a Mario remix called Getting Rid of Bowser which was even better.

Based on recent sales data, the future for the Darksiders series doesn't look good as the sale for Darksiders 2 have basically flat-lined since its release in mid-August.

According to Micheal Patcher, the game itself is in danger of not being able to break even since its not close to reaching the two million sales milestone needed. The biggest problem appears to be the game has no "legs" or is struggling badly with sales since its launch. Darksiders II launch managed to reach over a million copies sold from all platforms combined.

Although the good news is the Wii U version hasn't been released yet which should help sales but would probably need to sell as much as the other versions combined for THQ to be happy with Darksiders II sales.

THQ and Virgil Games had hinted the future of the series and a third game would depend on Darksiders II selling four to five million copies although most places believed THQ would be happy if it managed a more reachable mark of between two to three million copies sold.

EA is lashing out a bit at game reviewers for the poor reception and scores given to Medal of Honor: Warfighter.

The company stated the game does not deserve to be getting the low scores going as far as saying their internal "mock" reviews rated the game a lot higher leading up to its launch.

While the company still believes the game will sell a lot of copies with the public, very early sales data is showing the opposite being true. According to the data and predictions, Warfighter is on track to become the lowest selling game in the series with even EA already saying the launch sold "well below" their expectations. Analyst Michael Pachter thinks if the sales stay low enough, EA might end up killing off the Medal of Honor series in favor of a possible yearly schedule for the Batlefield series.

In terms of aggregate review scores, Warfihgter is also averaging the lowest scores in the entire history of the Medal of Honor series at an average score of 54. EA had hoped the game would have drastically improved from the previous Medal of Honor game which was a reboot of the series but only averaged a score of 76.

Read an article in oxm a while back that said the character shown in screenshots is just a placeholder, and that according to devs, the real protagonist is a "familiar character known for his gadgets and arsenal".

So yeah. Might finally get a Boba Fett game.

I don't see any possible way how mock reviews by the company who made the game could possibly be biased or inaccurate. Everyone else is clearly wrong.

According to recent rumors, the current batch of PS4 dev kits have been sent to developers.

The dev kits which have the codename of Orbis are rumored to be the second out of the four batches Sony will be providing with the final batch arriving by the Summer of 2013.

From the rumored details, the PS4 would be using the same blu-ray discs as the PS3 along with all the inputs being the same. AMD is supplying the chip for the PS4 which is from their A10 APU series. Also it appears the PS4 might launch with a 256 GB harddrive as the default size.

The UI or menu system is also rumored to be completely redesigned and allows for better multi-tasking than what the PS3 or even Xbox 360 currently allows.

In an interview with the Seattle Times, the director of the Halo series at 343 Studios, Frank O’Connor, reveals they've been working on Halo 5 for a while.

O’Connor revealed most of the current work for the game has been prototype stuff in regards to new technology the next Xbox might contain and to the storyline itself.

When asked during an interview, “You’re presumably working on the next version — “Halo 5” or whatever it’s going to be called will be the anchor tenant on the next version of the Xbox, right?” O’Connor offered the reply, “We’ve done as much prototyping and storytelling and the future arc of the universe as we have on technology. He also stated the series has no signs of slowing down in terms of ideas for the storyline by stating their "universe" is as rich as the ones in the Star Wars or Harry Potter series.

In regards to concerns about the series being milked, he didn't believe that is an issue since the public won't be concerned as long as the games remain good to play. Also said they are making sure future games don't create a convoluted mess with the overall storyline.

EA announces they are celebrating the 10th Anniversary of the Battlefield series by giving away the digital version of Battlefield 1942 as a free download for PC users.

Although there are several catches to the gift from EA such as the game can only be played and downloaded from their Origin service, none of the DLC packs for the game are included or free, and the free version is not compatible with physical/disc-based or non-Origin versions of the game for multiplayer.

EA stated the offer will last until March 1, 2013.

Need to decide on whether I want to get Forza 4 or Forza Horizons on thursday. Forza 4 is cheaper, but given the amount of DLC, I'll probably buy 1600 points card with it, so pricewise it will all be the same.

Forza 4 for sure. Feels a lot tighter as a game.

If you already had 4 since launch, I'd recommend Horizons as its great fun, but as a choice it would be pretty clear for me.

Considered the new Need For Speed as well, but as far as arcade racers go, the opinions are pretty unanimous that Burnout Paradise is the better game, and I've still got lots to finish in that one.

The thing I'm reading about Most Wanted is worse single player but better multiplayer than Paradise.

Either way, I've spotted a good deal on the PC version, so I may pick it up when I get paid.

Two collector editions for the Assassin's Creed and Metal Gear Solid series were recently announced by both Ubisoft and by retailers.

In regards to Assassin's Creed, the set is called "Assassin’s Creed Anthology" and will include all five games in the series along with their DLC. As of now the set is only exclusive to the UK region but could potentially be released elsewhere in the future.

The set costs 120 Euros and will be released on November 30th for the PS3 and Xbox 360.

Microsoft rumored to be working on a 7-inch gaming tablet which would be called "Microsoft Surface" and could be the reason why security was increased at their Redmond and Silicon Valley branches.

The tablet is rumored to be using an ARM processor and runs on a modified but heavily stripped version of Windows. The main focus for tablet will be on gaming with only a few non-gaming functions being useable on the device.

Microsoft is also producing the tablets at a separate location than their normal processing plants in order to avoid serious leaks to the media. Parts of the tablet are being made at their Silicon Valley offices which also could explain why security was increased only at these branches.

Silicon Knights lawsuit against Epic Games in regards to the Unreal 3 Engine took another turn as a judge has ordered all games made using the engine from them to be destroyed.

According to the court order, five games were specifically listed due to claims the source code for these games contained plagiarized Unreal 3 code. Silicon Knights have been ordered to destroy all unsold copies and also cover the costs needed for the destruction.

The games listed for destruction were:
* Too Human
* X-Men: Destiny
* The Sandman
* The Box/Ritualist
* Siren in the Maelstrom

In regards to X-Men: Destiny, they would be destroying all copies that were not taken care of from an earlier dump by Activision who was upset at the abysmal sales of the game.

So far the total results from Silicon Knights' lawsuit against Epic Games was their initial lawsuit being tossed, a counter-suit which they lost at the cost of $4.5 million, the return of all Unreal 3 engine assets, a drastic studio reduction, and now more money needed to be spent to cover the recent court decision.

Kill it off by all means. But a yearly BF release? No thanks. That'd kill that off too.

All they need to do is a simple following, that would benefit customer and them for money. Perhaps use MoH as a replacement for the "Bad Company" franchise of Battlefield, but either way:

2011: Battlefield 3
2011/12/13: DLC for Battlefield 3
2013: Bad Company 3 / MoH: <insert name>
2014: BF2143
2015: DLC for Battlefield 2143
2016: Battlefield 4

and so on.

To me another logical thing would be for BF to be purely Multiplayer and the MoH to be singleplayer games with no Multiplayer. DICE controls BF, and whoever in EA's range controls MoH / Bad Company.

It's seems logical, but I guess in the world of games... it's just an "idea" and certainly one that I would take up with my team in a management / staff meeting on the directions for the next 5 years.
